Getting proper legal advice is essential. This has recently been illustrated by the case of R v CHAMBERS. This case revealed that for about 8 or 9 years, the wrong Tobacco Regulations had been applied. This meant that potentially thousands of Defendants had been wrongly charged for the underpayment of the duty when thewy were not the ones who were legally bound to pay the duty. This will lead to a whole string of Appeals I will hopefully be handling.
This all happened because of poor advice. Both Customs and several solicitors acting for Defendants were not aware of the New Regulations and their impact upon sentencing.
The result was a catastrophe especially for those thousands of peope sentenced far too harshly.
